Extract from will of Joshua Bird, father:- "...the said Trust property In trust for and to be equally divided between and amongst m y sons William BIRD Charles BIRD Thomas BIRD and George BIRD and my daughters Elizabeth BIRD and Martha PICKLES the wife of Edwin PICKLES (Pilot) Provided that as to the share of the said Martha PICKLES to which she is or may become entitled under the trust aforesaid it is my Will that she shall not be entitled to the same absolutely but my Trustees or Trustee for the time being shall invest the same in their or his names or name and shall be possessed thereof Upon the trusts and for the purposes hereinafter expressed that is to say In trust to pay the Interest dividend and resulting income thereof and of the securities or investments of or for the same unto my said last named Daughter during her life for her sole and separate use and free from the power or control of any husband and so that she shall have no power to [ ] charge incum[ ] dispose of or receive the same in any way by anticipation and from and after her decease In trust for such of the children if more than one equally or the child if only one of my said daughter Martha who shall be living at or born after my death and shall attain the age of twenty one years or being daughters or a Daughter shall marry And on failure of the foregoing trusts then In trust for such person or persons as under the statutes for the distribution of the ef fects of intestates would have become entitled thereto at the decease of my said last mentioned Daughter had she died possessed of the same share intestate and a widow such persons if more than one to take as Tenants in common in the shares in which they would have taken under the same statutes And I declare that any sale of my real or personal estate and property may be made either by auction or by private treaty and my Trustees or Trustee as to the conditions time and mode of sale shall have all such and the same discretion as if the yor he were or was absolute Owners or Owner and with power to buy in and resell the premises to execute and rescind Contracts and to execute assurances of the premises sold that my said Trustees or Trustee shall and may apply the income of the aforesaid share in which my said daughter Martha takes an interest for life for the maintenance and education of any minor entitled in expectancy to such share that the Trustees receipts shall discharge persons paying purchase or other money or transferring trust property from liability in regard to the application thereof that no trustee shall be responsible for the deferring the sale of any real Estate my residuary personal Estate and property notwithstanding any consequent loss or expiration of interest I devise my trust and mortgage estates (subject to the equities subsisting therein) unto and to the use of the said Charles BIRD and William BIRD their heirs executors administrators and assigns the mortgage money being taken as part of my personal Estate In witness whereof I have hereunto set my hand the day and year first before written Joshua BIRD
