Joseph born 1799 Ireland. Sent to Australia for the crime of unlawful oaths; unlawful oaths was a crime instigated in 1795 through the unlawful oaths act by the Pitt Govt. designed to stem the rise of unionism uprising of workers and general agitation and organised way.
He was convicted as a "Whiteboy" (WB): Many of those convicted under the Insurrection Act of 1822 were known as Whiteboys. Whiteboy activities in the early 1820s included being absent from home after dark, possessing arms and ammunition, taking unlawful oaths, unlawful assembly, and sending threatening letters or posting threatening notices.
Sentenced to life, Wexford, Ireland 30th July 1833. Came on the vessel "James Laing" from Dublin, Ireland 16th February 1834, arrived Sydney, NSW, June 29th 1834.
Joseph was 34 (DOB 1800, Carlow Co. Ireland.), married with 4 male and 1 female children. He was a shepherd. (Website Irish convicts to NSW 1788 - 1849).
Ticket of leave granted no. 43/2372, allowed to remain in Braidwood Oct 11th 1843. Convict Pardon 48/1949, 1 Nov 1848.
Probably the 4 sons of this Joseph Byrne; the brothers Byrne (John, 22, James, 20, Patrick, 18 and Michael, 16), arrived in Sydney as Assisted Immigrants on board the 'Success' in 1849. (NSW State Records Assisted Immigrants, Reel 2460 Fiche 837).
The brothers came to Australia to join their father Joseph, who had been transported as a convict.
