James William Vivian, b. 1805 in Dorsetshire England. Majority of information in this text supplied by Pat Evans.
James was convicted on 14th March 1828 at Dorchester ENG. & received a life sentence for stealing a heifer, he was sent to the colony & arrived December 1829 per Claudine.
James was obviously educated as his record states that he could read & write. His description was given as being 5' 6 1/2", ruddy complexion, light brown hair, blue eyes. He also had a small scar in the centre of his forehead & tatoos on both arms. His left arm had a mermaid, a woman & a crucifix. His right arm had the letters J D E V G M V ???? Speculation is that these are the initials of his parents??
19 Jan 1836 - An application to marry was submitted by James Vivian spouse named in application is Catherine Forrest (age 18).
1837 - he was assigned to Jemima Jenkins at Campbelltown NSW, who was a landholder of 9,075 acres of which 552 acres was cleared & 134 acres cultivated. The property held 60 horses, 2,000 cattle & 320 sheep at that time.
1838 - he obtained a ticket of leave... no reference number.
1838 - 'Convict bank warrent' #38/108 (item no.4/7075) which means he had a bank account and the Government held it on his behalf.
1839 - he was stated to be 'T/L' when he married.
Dec. 1840 - In the employment of George Cox (50acre farm in Illawarra) Catherine also employed by Cox. ( Australasian Chronicle Dec.19 1840)
1845 - James William Vivian received a Conditional Pardon ( #45/599 reel #782) dated 13 Aug. 1845. Then he disappears. All states checked by Pat (Oct. 2006).
The Jemima Jenkins that James was assigned to in 1837 was Jemima Forrest, prior to her marriage to Robert Jenkins in 1813.
I (Pat) also found a letter posted to Jacon Vivian on 3rd July 1863 to Wagga Wagga NSW was unclaimed. He married Catherine Forrest, married 12 Feb 1839 in C of E Dapto, Wollongong NSW.


James married Catherine Forrest, daughter of Thomas Forrest and Ellen Wray, on 12 Feb 1839 in Dapto C of E, NSW Australia. (Catherine Forrest was born in 1821 in Cork County, Ireland UK, died on 20 May 1874 in Edward St, Balmain, Sydney, NSW Australia and was buried on 22 May 1874 in Balmain Cemetery, Sydney, NSW Australia C of E section.)
