A Norwegian sailing ship ignored the signals of the fort to heave to and the forts C. O. Major Charles Luya, a Waillasey dentist, ordered a shot to be fired across the bows. This missed and landed in the sand dunes across the river near Hightown. A second shot hit the bows of an 'Allen' liner at anchor. When the ship was finally intercepted the master said he was unaware of the declaration of war. When asked why he had not heaved to when fired upon he said, "I think you only make play. " Meanwhile the shell which had landed at Hightown was taken to the H. Q. of the Mersey defences in a bucket by a householder who demanded to know what was going on. This shell found its way back to to Perch Rock where it was displayed in the officers mess. There is a story that this was engraved "A Present From New Brighton" in imitation of the the souvenirs sold in the town. " Biographical: LUYA, Charles John, Major Lanc. & Ches. RG.A. (TF.).
