Richard was tried and convicted at Hampshire Assizes on 9 March 1811 for burglariously entering the banking-house of Messrs. Waller and Co. and was sentenced to death. The sentence was commuted to transportation for life to Botany Bay, NSW, Australia. He left London, England as a convict on 3 September 1811 and arrived in Sydney, NSW,on 18 January 1812 on the ship Guildford.

Richard married Charlotte Stanley, daughter of John Dixon and Hannah Stanley, in 1825 in St Matthews C of E, Windsor, Sydney, NSW Australia. (Charlotte Stanley was born on 20 Dec 1810 in Sydney, NSW Australia ²⁰³ and died on 10 Mar 1853 in Darby Murrays' Flat, Goulburn, NSW Australia.)
