William Dawes was shot by Charles Oliver Brearton on the 26th September 1852in Melbourne. A trial into his murder was conducted on 19th october1852 and he and Elizabeth Dawes(William's wife-although no marriage has been found in the records)were charged with Manslaughter. Charles went to Goal for two years and Elizabeth Dawes for 9 months.

WILFUL MURDER
Charles Oliver Brearton and Elizabeth Dawes wo had previously pleaded not guilty, were arrainged for the wilful murder of William Dawes on 26 th September last.

The following jury was then empanelled:- W H Tuckett, forman, Wm Williamson, Geo Thomas, Thomas Trotman, Richard Wicks, Saml Taylor, Saml Thorpe, George Taylor, Jas Warman, G Vinge, John Towns, Alex Walker. The male prisoner exercised his right of challenge objecting to Messrs. Alfred Turner, George Taylor, John Tankard, James Taylor, Charles Williamson, Peter Virtue, and James Turner.
Messrs. Michie and Smyth appeared for the male prisoner and Mr Wrixon for the female.

It appears that William and Elizabeth had one child, and apparently William had ill treated Elizabeth so she went to live with Charles Brearton, (this happened on a couple of occasions), taking the child with her. William then had a few drinks and went and demanded Charles give back his wife and child, when Elizabeth wouldn't go, a few punches were thrown and after a scuffle a couple of shots were fired, and William was shot and died. There was a lot more to the story but it would not fit into this programme.

Manslaughter
Charles Brearton and Elizabeth Dawes who had been convicted of manslaughter, were placed in the dock for sentence.
His honour passed sentence upon the prisoners in a very feeling manner, recapitulating all the circumstances of the case which we have recently placed so fully before the public, that it would be tedious to allude to it at any length.
The male prisoner was sentenced to two years imprisonment, and the female prisoner to nine months imprisonment. Both prisoners appeared remarkedly unconcerned.[Dawes Family.GED]
