Sale of Uniform Disputed.
In the City Court on Thursday Gilbert Lovitt, retired superintendent of police, sued George Thorburn, a first-constable, for 14 pound, said to have been due on the sale of an officer's uniform. Mr. D. Lazarus appeared for complainant, and Mr. R. Dobson for defendant. Complainant's case was that in 1927 he visited Creswick and Thorburn, who was then stationed there, asked him what he intended to do with his officer's uniform as he was to retire a few months later. Thorburn agreed to purchase the uniform at 14 pound, and was told that he could take his time about paying. The uniform was delivered later at Wendouree station, to which Thorburn had been transferred. Later witness wrote offering to take 7 pound within three months, but received no reply. In October he received word that the uniform had been returned to the post-office. The defence was that there had been no purchase. Thorburn had
passed all his officer's examinations in 1925. He had talked about the uniform to Lovitt and had suggested that it should be sent to the police institute for sale. Constable Pattison gave evidence that he had heard the two parties discussing the matter of selling, and Thorburn had said, "It might be no use to me. I might never be promoted." He and Thorburn tried on the uniform. Inspector Hewitt said that in
1928 Lovitt offered to accept 13 pound for the uniform. An order was made for the
amount claimed, with 3 pound 10 shillings cost. A stay of 28 days was granted.
