Michael was a miner and lived at Bald Hills Road, Creswick and within 2 miles of the place of publication of the Creswick Advertiser for 40 preceding years. His wife, Margaret, was initially in his will. He was illiterate and signed his will with an X. Margaret apparently did "nothing" regarding probate and signed administration consent for their daughter, Margaret. Margaret, the widow, also signed with an X. Death notice appeared in the Creswick Advertiser 12 Feb 1908. He left 5 acres of land at Creswick. It is also recorded that widow Margaret was ignorant of the necessity for probate proceedings.
The surviving children are listed as:
Catherine - wife of Phillip? Pollard of Smeaton.
Ellen - wife of David Crockett, Echuca (my great grandmother.
Hannah - wife of James Harrison of Ballarat.
Margaret Dwyer - Creswick - appears to have been a spinster
Norah Dwyer - Creswick - appears to have been a spinster
William Dwyer - of Berrigan
Michael Dwyer made a will on 22 Sep 1888 that was witnessed by John Dwyer (died 7 Jan 1889) and John Roberts (died 23 Dec 1905).
On 11 Feb 1908, Margaret (younger) placed a probate notice in the Creswick Advertiser and it appeared on 12 Feb. On 3 Mar, 1908, both Margarets and a James Dunne and Charles Tank are all in the "office" and signing affidavits re the old will that, according to a Registrar-General's letter of 17 Apr was never deposited. All but Margaret (younger) had to swear to its authenticity and Margaret (elder) swore that she was present when Michael made his 1888 Will and signed it in the presence of his two witnesses and gave his approval after it was read to him - he was illiterate. Margaret (younger) swore that Michael had died 14 Oct 1902. On 3 Mar 1908, Margaret (elder) signed over administration to Margaret (younger). James Dunne and Charles Tank were "used" as witnesses to the affidavits, etc., on 3 Mar. The two Margaret's affidavits had their swearing crossed out and were re-sworn on 12 May 1908. This was due to some errors/alterations that were not initialled on the first day's signing and there was no mention as to the reason why Margaret (elder) had signed hers with "X"..
