CATTLE STEALING.
Richard Cahill was indicted for stealing two cows and two calves, the property of Catherine Slattery, from Phil's, Creek, on the 1st July, 1849. The prisoner pleaded not guilty, and was defended by Mr. Wadeson.
It appeared from the evidence that the prosecutrix, Catherine Slattery, had lived with a man named Cornelius Daley, who died intestate, and had borne five children to him. He was the owner of a number of cattle which she appropriated, two of which a poley cow, with red sides mixed with strawberry, with a white back and belly, and branded CD on the near side, and a brindle cow, with a white back and belly, of the same brand, were removed from the run, where they were seen a fortnight before Daley's death.
The prisoner had on one occasion done some thrashing for Daley, and was paid in cattle, but the missing cows and calves formed no part of the payment. The brother to the prosecutrix found the brindle cow on Mr. Hammond's run, where he saw the prisoner, who told him that the cow was his in presence of Mrs. Hammond. Thomas Hammond deposed that he resided on the Burrowa River, and that in September last the prisoner left thirteen head of cattle in a charge, and shortly afterwards six more, amongst which were two cows answering the description above given of the stolen cattle, and which he said he had bought from Cornelius Daley. The poley cow he had since returned to the prisoner, and the prosecutrix brother had since claimed the brindle cow as his sister's and had taken it away.
Mr. Wadeson, ' in defence, observed, that al though the case at first sight bore strong marks of suspicion, upon closer examination they disap peared. It appeared to him that theft could as easily be fixed upon Mr. Hammond as upon the prisoner, and that the former might easily trump up his present story to remove the guilt and its consequence upon another. The Chairman in summing up observed that, whether the prosecutrix was the owner of the cattle or not, they were in her charge, and she was doubtlessly responsible for their safe keeping. The evidence of Slattery and Hammond clearly proved possession on the part of the prisoner, and if the jury deemed it credible they could have no difficulty in arriving at their verdict.
The jury retired for about a quarter of an hour, and found a verdict of ' NOT GUILTY ! ! !' against the prisoner. ' Not guilty !!!' did we say ? yes, ' not guilty ;' and he was accordingly discharged.
